Subject:   Validity of Degrees obtained through Distance Mode of    Education.

Reference: Cabinet Decision No. 104/14/2012  dated 16-05-2012.


Government Order No.  252 -HE of 2012

Sanction is accorded for:


a)               approval to the recommendations made by the Committee constituted, vide Government Order No. 442-GAD of 2011 dated            13-04-2011 read with Government  order No. 558-GAD of 2011 dated    13-05-2011, reproduced below:-


i)                    the degrees, obtained through distance education mode, which have been approved by the Distance Education Council and awarded from their headquarters by University Grants Commission recognized Universities, established by an Act of State Legislature, shall be recognized for the purpose of employment as it is the prerogative of the employer to prescribe the eligibility for any post or service;


 ii)                  the degree awarded through Distance Mode by the Central Universities, established under the Act of Parliament and having jurisdiction to extend their activities in the entire country shall also be recognized;


 iii)               the degree obtained through distance education mode from off-campuses which have been established by the State Universities beyond their territorial jurisdiction shall not be recognized;



iv)                that sub-rule (3) of rule 20 of the Rules notified vide SRO 339 of 2005 dated 20-12-2005 allows students already enrolled in these institutions, to continue their studies till the conclusion of their academic programme, the degrees of all those who had acquired their degrees prior to coming into force of the rules  those allowed to continue their studies till the conclusion of their academic session shall be considered for being recognized with necessary amendments in law wherever required;



 v)                  M. Phil and Ph.D. Degrees obtained through distance mode shall not be recognized as equivalent to the regular M. Phil and Ph.D. degrees awarded by any of the Universities as has been prescribed by the University Grants Commission vide its notifications issued from time to time in this regard;



vi)                the degree awarded by the Universities, whether situated within or outside the State through distance mode in the subjects falling in Science Stream, where practicals are part of the curriculum, shall not be considered as equivalent to the corresponding degrees awarded through regular mode by the State Universities. However, degrees in such of the Distance Education Council approved science subjects where practicals are part of the curriculum and are conducted from within the respective campuses of the University Grants Commission recognized Universities, established by an Act of the Parliament or the State Legislative, shall also be recognized;




vii)              such of the courses in the streams of Information Technology, Computer Sciences and Management which are approved by the Distance Education Council and All India Council of Technical Education and degrees whereof are awarded by the University Grants Commission recognized Universities, established by an Act of Parliament from within the territorial jurisdiction of these Universities shall also be recognized;


viii)           where the Degrees in the Distance Education Council approved courses, obtained through distance education, are such that these do not correspond to the degrees obtained through regular mode from the Universities of Kashmir and Jammu and the students claim their equivalence, such cases shall be referred by the recruiting agencies on case-to-case basis, to the State Universities of Jammu and Kashmir for drawing equivalence. The decision taken thereto shall be final;



ix)               the present system of screening for the purpose of short listing being adopted by the recruiting agencies wherein recruitment is made by giving weightage to the performance in the academic examinations should be dispensed with and the Services Selection Board or for that matter any authority including Public Service Commission  with the responsibility to make selection for any office or the post under the State shall hold a uniform written test for all the eligible aspirants for advertised post(s). The marks obtained in this written examination shall be taken into account for making selections. Where the response to an advertisement notice is enormous, the recruiting agencies including Jammu and Kashmir Public Service Commission shall go in for a uniform screening test to short-list the candidates for the written examination and subsequently make the selections as per the procedure laid here in above. However, the candidates having qualified NET/SLET or/and having acquired Ph.D. shall be exempted from appearing in screening test and written test where qualification prescribed is NET/SLET or Ph.D. The recommendations as such need to be incorporated in the  relevant recruitment rules by the administrative department and the examination rules by the Jammu and Kashmir Public Service Commission/other recruiting agencies;



x)              the changes in the Recruitment Rules in line with the above decision to be effected by all the Departments to obviate the possibility of litigation;



xi)              for the purpose of granting promotions to the in-service candidates on the basis of the additional qualifications acquired through distance mode of education after satisfying all procedural requirement and subject to the fulfillment of the principles/conditions laid down hereinabove, the concerned administrative departments or the authorities competent to place/promote them in the next higher grades, shall put in place a mechanism, as they deem fit, to assess the standards of the degrees so obtained in order to treat them equivalent to the degrees awarded by the Universities through regular mode of education. The said mechanism can be akin to the written test that has been decided to be conducted by the recruiting agencies in respect of eligible aspirants to the advertised posts;        and


b)              approval to the necessary changes in the Recruitment Rules to be effected by all the Departments.

    The controversy around Nestle's Maggi noodles has caused panic throughout the nation and it doesn't look like it will die down any time soon.

    After the initial test results by Uttar Pradesh Department of Food and Drug Administration (FDA) showed harmful levels of monosodium glutamate (MSG) and lead in Maggi, various states across India and even Bangladesh conducted tests on Maggi to find out whether the food product is safe or not.

    The controversy around Maggi has led to tests being conducted across the country.

    The entire controversy began when the UP FDA last month asked Nestle India to withdraw a batch of Maggi noodles "which were manufactured in February 2014" after it found high levels of added MSG, a taste enhancer, in the noodles and lead beyond permissible limits.
